This Privacy Policy explains how we collect, use, disclose, and safeguard any personal information that you provide to us in the course of using our website and online education services (collectively, the “Website”) or that we may otherwise collect from or about you in connection with our products and services, as well as your choices and rights with respect to your personal information. Partnership and Co-Marketing: Joint Collection and Use

In some instances, our Website and courses are offered through partnerships with educational institutions and companies whereby we promote and deliver the Website and relevant courses to professionals on a co-branded basis with such educational/business partners (each, a “Co-Marketing Partner”). In these instances, personal information collected in connection with the co-branded website and course offerings is collected by both EmergingEd and the relevant Co-Marketing Partner. EmergingEd will collect, use, disclose, and protect personal information collected through such partnerships and co-branded websites in accordance with this Privacy Policy. However, information controlled by the relevant Co-Marketing Partner shall be subject to such partner’s own privacy policy/notices.

Collection of Your Information

You can generally visit our Website without revealing any personally identifiable information about yourself. However, to enroll in our courses and access certain options and services, we may ask you to provide certain personally identifiable information, and without providing such personally identifiable information, you may be unable to enroll or access certain options and services. The following is personally identifiable information that we may collect from or about you:

Course Registration and Enrollment

Information obtained from you on course registration and enrollment forms, as well as information you include in your EmergingEd account profile online and information generated in connection with your course participation, such as the following:

  • Identifiers and contact information, including first and last name, email address, telephone number, postal address, social media account name or handle, Social Security number, EmergingEd online account username and password, and date of birth. This registration information may also be gathered if you register for certain courses via our call center, postal mail, or fax. If we partner with your employer (or another company you are affiliated with) to offer you courses on a co-branded basis, we may also receive your name, email address, phone number, and postal address from your employer. When you register and pay for our courses through our third party payment processor, we will receive your postal address from such payment processor.
  • Course registration information, including courses you enrolled in, courses completed and not completed, and course dates and times.
  • Photographs, including an EmergingEd online account profile and social medial profile photos shared with us or via the Website.

Course Completion Surveys

Information submitted by you on Course Completion Surveys, such as the following:

  • Course registration information, including course taken and your opinions regarding the course, course materials, and instructors.
  • Professional and employment-related information, including current employment status, job function, job title, employer name, and salary range.
  • Education information, including the highest level of education completed.
  • Characteristics of protected classifications under California or federal law, such as your gender and age range.
  • Inferences drawn from any of the information collected via surveys and course enrollment to create a profile about you reflecting your course preferences, attitudes, and abilities.

Inquiries and Information Requests

Information obtained from you when submitting an inquiry or requesting information (including via email, our call center, or other contexts), such as your first and last name, email address, telephone number, postal address, social media account name or handle, and information requested.

Information We Collect Through Your Use of Our Website

As you navigate through the Website, certain information may be passively collected (i.e., gathered without you actively providing information) using various technologies and means. Our systems may automatically gather information about the areas you visit on the Website and collect operational information about the technology you use, such as your browser, type of computer, operating systems, geolocation, and internet service providers. Like most web sites, we and our service providers (including advertising providers) may track IP addresses during your visit and may also use session, persistent and flash cookies, web beacons, pixel tags and other successor technologies. We may request access or permission to and track location-based information from your computer or mobile device, either continuously or while you are using the Website, to provide location-based services. Data From Social Networks

User information from social networking sites, such as Apple’s Game Center, Facebook, Google+, Instagram, Pinterest, Twitter, etc., including your name, your social network username, location, gender, birth date, email address, profile picture, and public data for contacts, if you connect your EmergingEd account to such social networks. This information may also include the contact information of anyone you invite to use and/or join the Website. The information we obtain from these services often depends on your settings or the applicable provider's privacy policies, so please check these policies before granting us access. If you give us permission to access this information, we will use it for the purposes described in this privacy notice.

Use of Your Information

We may use the information we collect from and about you (and your device) to create, maintain, and customize your enrollment with us; enroll you in and provide our online professional development and upskilling courses; respond to your questions or comments; provide you with customized content, targeted offers and advertising through our Website, online services, other sites, and via email or text message; contact you with information, newsletters, and promotional materials from us or on behalf of our partners and affiliates; develop new products and services, and improve our existing products and services; address problems and review the usage and operations of our Website or business, and improve our Website content, products and offerings; protect the security and integrity of our Website and our business; respond to law enforcement requests and as required by applicable law, court order, and governmental regulations; and as otherwise described to you at the point of data collection and in this Privacy Policy.

  • By Law or to Protect Rights. We reserve the right to disclose information we collect from and about you (and your device) if required to do so by law or by a regulatory authority. We may also disclose your information as part of an investigation or enforcement action relating to improper or illegal conduct in connection with our online services or other products, including, without limitation, any situations that may potentially involve threats to the safety or privacy of any person or misuse of our Website.

We and our service providers may create aggregated and/or de-identified databases which we otherwise use or share, but such databases will not include your personally identifiable contact information.

Third-Party Payment Processor

We use a third party payment processor to process payments made to us. In connection with the processing of such payments, we receive your postal address from the payment processors, but we do not receive or retain any financial or other information such as credit card numbers. Rather, all such information is provided directly to our third party processor, PayPal, whose use of your personal information is governed by their Privacy Statement, which may be viewed on their website located at the https://www.paypal.com/us/webapps/mpp/ua/privacy-full.

Postings/Discussions

If you post information to any message boards, discussions, or other forums (“Forums”) through the Website, that information is publicly available to anyone that has access to such Forums, and we cannot control how other parties will use that information. Please use care when posting to publicly available Forums. Your profile information is accessible through the Website in connection with your postings. You understand and acknowledge that you are responsible for whatever content you submit to a Forum, including its legality, reliability, and appropriateness. This site is not intended for children under the age of 13. We will not knowingly solicit or collect personal information from visitors in this age group. How often we send you communications will vary depending on the number of programs and services you are enrolled in. You may revoke your consent to receive certain communications at any time. To stop receiving text messages reply "stop" to any of our texts. To stop receiving emails click the "unsubscribe" link provided at the bottom of our emails. To stop receiving phone calls, notify us of your request via phone, text message, or email. We will make a commercially reasonable effort to comply with any communications from you opting out. By contacting us to opt-out of a certain communications, you consent to receive a final communication confirming your opt-out.

Agreement to Engage Electronically

You understand and agree that checking the box agreeing to our Acceptable Use Policy and Privacy Policy, you are agreeing to execute this consent in electronic form.

Your Choices | Updating Your Personal Information

You may update and amend personal information you include in your EmergingEd account profile at any time via your account online. For record keeping and compliance purposes, we will retain certain information collected from or about you in conjunction with our Website and courses and other commercial transactions.

You can opt out of promotional emails we may send to you by following the “unsubscribe” instructions provided in such emails. If you opt out of our marketing communications, we may still send you transactional and relationship emails, such as emails about your course registrations and account.

You also have the right to request (“Request to Know”) that EmergingEd disclose what personal information we have collected, used, disclosed, and sold (if applicable) about you in the preceding 12 months, including the right to request any or all of the following:

  • Categories of personal information EmergingEd has collected about you in the preceding 12 months.

Right to Deletion

You have the right to request that EmergingEd delete personal information about you which we have collected from you (“Request to Delete”). To submit a Request to Delete, please call us at +1-888-311-4933 or send an email to us at support@emerginged.com with “Delete” or “Request to Delete” in the subject line.

Please be aware that a Request to Delete does not ensure complete or comprehensive deletion of your personal information and that there may be circumstances in which the law does not require or allow deletion even if requested, such as when the information is necessary in order to complete the transaction for which the personal information was collected, to provide a service requested by you, or to comply with a legal obligation.

Right to Opt-Out of the Sale of personal information

California law gives you and the right to prevent businesses from selling your personal information. EmergingEd does not sell personal information about you or anyone else, including minors, students, customers, or Website visitors.

Right Not to Be Subject to Discrimination

You have the right to be free from discrimination or retaliation for exercising any of your privacy rights under California law. EmergingEd does not and will not discriminate against you for exercising your privacy rights.

Verifying Requests

We value the security and confidentiality of your personal information. Therefore, if you submit a Request to Know or Request to Delete, we must first verify your identify to make sure that you are the person about whom we have collected personal information. We verify every request carefully. Along with your request, we will ask that you provide us with certain information previously collected from you, such as your email address, phone number, postal address, and past course registrations.

Use of Authorized Agent

If you are making any of the requests above as an authorized agent, we will require notarized written authorization or a notarized Power of Attorney. Additionally, we will seek to verify your identity in the manners stated above (depending on the request type). To make a request using an authorized agent, please email us at support@emerginged.com.

Additional Information

We will maintain records of requests that are made that include the date of request, nature of request, manner in which the request was made, the date of our response, the nature of our response, and the basis for any denial of the request if it is denied in whole or part.

You are not required to create an online account with us in order to exercise your rights.
